These Terms of Service (the "Terms") govern your access to and use of ServeLeague ("ServeLeague", "we", "us", or "our") and the Service described below. Please read them carefully. By using the Service you agree to these Terms.
Acceptance of terms
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you use the Service on behalf of a club or organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree, do not use the Service.
Description of the service
ServeLeague is a software-as-a-service platform for managing racket sports clubs. It helps clubs run leagues, sessions, and matches; calculate ratings and standings; manage memberships, facilities, bookings, and events; and communicate with members. Features available to you depend on your plan and on features enabled for your club.
Accounts and eligibility
You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorised use. You must be old enough to form a binding contract in your jurisdiction to hold an account.
Subscription plans and billing
The Service offers a free tier and two paid plans: Club at $39/month and Pro at $89/month (prices in US dollars). New customers can start a 30-day free trial with no credit card required.
- Billing: paid subscriptions are billed through Stripe, our payment processor.
- Auto-renewal: paid subscriptions renew automatically at the end of each billing period until cancelled.
- Cancellation: you can cancel at any time. Cancellation stops future renewals; your plan remains active until the end of the current paid period.
- Refunds: fees are non-refundable for partial billing periods except where a refund is required by law.
We may change plan pricing or features. We will give reasonable notice of price changes, which take effect at your next renewal.
Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Upload or share content that is unlawful, infringing, defamatory, or that violates others' privacy or rights.
- Attempt to gain unauthorised access to the Service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service, including by introducing malware or overloading our infrastructure.
- Reverse engineer or copy the Service except as permitted by law.
- Resell or provide the Service to third parties except as expressly permitted.
Customer data and ownership
As between you and ServeLeague, you (and your club) own the club and member data you submit to the Service ("Customer Data"). You grant us the rights needed to host, process, and display Customer Data in order to provide and improve the Service. ServeLeague grants you access to the Service under these Terms; we do not claim ownership of your Customer Data. You are responsible for the accuracy of Customer Data and for having the necessary rights and consents to provide it. Our handling of personal data is described in the Privacy Policy.
Intellectual property
The Service, including its software, design, and content we provide, is owned by ServeLeague and its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in the Service. "ServeLeague" and our logos are our trademarks and may not be used without permission.
Third-party services
The Service integrates with third-party services such as Stripe (payments), Google (analytics and advertising), Cloudflare (hosting and analytics), and our email provider. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services and do not control their operation.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that ratings and results calculated by the Service will meet your specific requirements. Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law.
Limitation of liability
To the maximum extent permitted by law, ServeLeague and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to these Terms or the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnity
You agree to indemnify and hold harmless ServeLeague and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Customer Data, your use of the Service, or your breach of these Terms or of applicable law.
Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends. We will handle any Customer Data after termination as described in the Privacy Policy. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnity) will survive.
Changes to the service and terms
We may modify or discontinue features of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of New Zealand, without regard to conflict of law rules. You agree to the exclusive jurisdiction of the courts of New Zealand for any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer protections available to you where you live.
